Property owners throughout Minnesota are obligated to know their property’s boundaries before building a new fence. All fences must be built within your property lines unless an agreement is signed with your neighbors. Fences cannot impair road vision, block sidewalks, or obscure alleyways.

As long as the new fence construction doesn’t require entering a neighbor’s property, you are not legally required to notify them of new fence construction. However, it is still the neighborly thing to do by informing them of new construction. Our workers would also appreciate it if neighbors are notified to avoid any unwanted surprises.

All fence construction in Chaska requires obtaining a fence zoning permit. The application must include an attached site plan that details the fence location, a full description of the fence that includes material and height, and a signature that makes the property owner responsible for building within property lines.

The fee to submit a fence zoning application in Chaska is only $10.

Chaska is unique in that the blocking of easements is not strictly prohibited. However, the city is not liable for damage to fences or gates that may obstruct the access of easements by city employees or authorized contractors. Examples of easements that may be of concern are utility boxes, utility poles, fire hydrants, and other critical pieces of localized infrastructure.

To be on the safe side, we highly recommend that your new fence doesn’t prohibit access to any of these easements.
