All property owners in Minnesota must know their property boundaries before a new fence can be built. All fences must be built within your property’s boundaries unless an agreement is signed with the applicable neighboring property.

If the new fence can be constructed without entering a neighbor’s property, then there is no legal requirement to notify them. However, it is still good practice to give your neighbors a heads-up. No one likes being surprised by new construction, especially if they have kids or pets.

Chaska does have more permit requirements than the typical city in Minnesota. All fences require obtaining a fence zoning permit from the city of Chaska. The application must include a site plan that details the new fence location, a thorough description of the fence which includes materials used and fence height, and the property owner’s signature affirming that they are building within their property lines.

There is a $10 application fee for the fence zoning permit in Chaska.

The city of Chaska has changing height requirements based on the fence’s location in relation to the house.

Rear fences can be up to a maximum of six feet in height. Front and side yard fences are limited to 4 feet in height and must have an opacity of 50%. This means that privacy fences in Chaska are mostly prohibited. Northland Fence may be able to obtain special permission on your behalf if a side or front yard privacy fence is desired. Unlike most cities in Minnesota, Chaska does not mandate that corner lots follow the “visibility triangle rule.” This allows more flexibility when building a fence on corner lots.

The city of Chaska is unique in that the blocking of easements is not prohibited. However, the city is allowed to damage or break fences that block access to easements without being responsible for repair expenses.

For that reason, we strongly recommend that your new fence doesn’t block access to easements such as utility boxes, utility poles, fire hydrants, etc.
