Eagan requires that all new fences and any support footing be within the property’s boundaries. An exception may be made if an agreement is signed with the neighboring property.

As long as you don’t plan on entering the neighbor’s property during construction, Eagan does not legally require that you notify them. However, giving your neighbors a heads-up before construction is the polite thing to do. This is especially true if your neighbor has kids or pets.

Even if you plan to follow all of Eagan’s fence requirements, a zoning permit is still required. Fortunately, zoning permits are free to apply for unless an inspection is needed. Our team will take care of obtaining the proper zoning permit for your fence.

Building outside of the city of Eagan’s fence requirements mandates obtaining a building permit. A building permit does have a fee based on the cost of the project. Building permits can be difficult to obtain based on what type of fence you want to build. Our team can help with the application process.

Eagan has stricter requirements on older fences. Old fences cannot display any loose or rotting pieces, holes, gaps, or overall defects. Painted fences may not display more than 20% of peeling, cracked, chipped, or deteriorated paint.

Eagan has fluctuating height requirements based on the fence’s proximity to the house and additional restrictions for corner lots.

Fences on the back boundary may not exceed 6 feet in height. Fences that extend into the side or front yards cannot exceed 42 inches in height. Corner lots have additional restrictions, as Eagan prescribes the “window of visibility rule.” Fences within 30 feet of an intersection may not exceed 30 inches in height. Eagan does not mandate any opacity or transparency requirements for front or side yard fences.

Any new fence, regardless of location, must have the finished end facing away from the owner’s lot.

These height and location restrictions may be waived if approval is obtained with a building permit.

Eagan permits building on or near easements if persimmon is granted by the engineering department. This usually entails obtaining a building permit. Even if a building permit is granted, the owner is generally held responsible for maintaining reasonable access to easements such as utility boxes, fire hydrants, and other localized infrastructure.
