As the homeowner, it is your responsibility to know the exact boundaries of your property lines. You should be aware of any easements on the property because you build at your own risk and need to contact Public Works for storm drainage easements to ensure your fence complies with ordinances. When building on your property line, you will need permission from neighbors who share the property line. If you install the new fence entirely within your property, no law requires you to notify your neighbors. However, being a “good neighbor” can go a long way in maintaining friendly relationships, so you can choose to let them know as a courtesy.

Whether you need a permit depends on the height of your fence. If your vinyl fence panels exceed seven (7) feet in height, you will need a building permit issued by the City of New Hope before starting your project.

There are varying fence height restrictions depending on the location of the fence. A fence installed in a front yard may not exceed 42 inches. When your property is a corner lot, and the front of your home faces a side of the corner lot, the fencing cannot exceed 42 inches. Fencing in the rear or side of a property cannot exceed eight (8) feet.

It is generally not a good idea to build a fence on an easement. New Hope maintains an easement to access any utility lines, cables, and pipes. While you could, in theory, build a fence on an easement, you do so at your own risk.
