Are You Up to Code?

In Minnesota, every city (and potentially HOA) has unique regulations and codes for fencing installations. Whether it’s your fence height, style, or access to utilities — it’s crucial to understand what is allowed in your area. Before breaking ground, be sure to read up on your city’s local laws. Learn more about your city’s fencing codes today.

WHERE CAN I PLACE MY FENCE ON THE PROPERTY?

Regardless of your city’s code, all fencing must be placed within your property lines. The owner of the property is responsible for defining exact property lines. Your fencing system should never block public rights of way, traffic visibility, or access to utility easements such as telephone poles or fire hydrants. It’s important to note that property owners should consult with their local laws before breaking ground on a winter fence installation to avoid potential fines or neighbor disputes.

Our fencing experts can help you plan your installation as well.

DO I NEED TO NOTIFY MY NEIGHBORS? IF SO, WHEN?

If your winter fence installation takes place within your property lines, there’s no legal requirement to notify your neighbors. With that being said, it’s always recommended that you disclose construction plans to your neighbors as a common courtesy.

DO I NEED A FENCE PERMIT?

Most cities have codes and regulations that require a permit, especially if your fence is taller than 7 ft. Fences above 8 ft. may require an additional variance depending on your location. Do submit an application for a permit, you’ll need a precise site plan illustrating all aspects of your property.

WHO CALLS THE UTILITIES WHEN INSTALLING A FENCE?

Throughout the state of Minnesota, Gopher State One Call needs to be contacted by the installer of the fence. We’ll take care of locating and marking utility lines to avoid potential disruptions.

CAN I BUILD MY FENCE ON AN EASEMENT?

Yes, but it’s not recommended. Easements for public passage or utilities need to be accessible at all times. We try to avoid winter fence installations on easements; however, if you must surround it with your fence build, contact your local planning department for permission.

ARE THERE ANY DESIGN OR MATERIAL RESTRICTIONS?

Throughout Minnesota, barbed wire and electric fences are banned.
